The legal landscape

What Is the Digital Personal Data Protection Act?

India’s DPDP Act, 2023 sets a framework for processing digital personal data. What a business needs to do depends on its activities, data processing and the provisions that apply to it.

01

Personal Data Protection

Understand what personal data you collect, why you use it and who handles it.

02

Consent & Transparency

Review notices and the consent approach applicable to each processing activity.

03

Data Security Safeguards

Identify proportionate technical and organisational protections and breach workflows.

04

Individual Rights & Requests

Plan for applicable access, correction, erasure and grievance processes.

Phased commencement

13 Nov 2025

Selected Act provisions and Rules took effect, including institutional provisions.

13 Nov 2026

The notified one-year tranche is scheduled to take effect.

13 May 2027

The notified eighteen-month tranche, including many core processing obligations, is scheduled to take effect.

Based on the government’s Act commencement notification and DPDP Rules, 2025. Dates and applicability are subject to government notifications and each organisation’s circumstances.

Common questions

DPDP Services FAQ

What is the DPDP Act, 2023?+

It is India’s law for processing digital personal data. Its provisions are being brought into force in phases, together with the DPDP Rules, 2025.

Does the DPDP Act apply to my business?+

That depends on your activities, the personal data you process and the applicable provisions. A scoped assessment can help identify the questions your legal adviser should resolve.

Is DPDP certification mandatory?+

The Act and Rules do not establish a general mandatory DPDP compliance certificate for businesses.

Can Kaivan Tech issue a DPDP compliance certificate?+

We can issue a private assessment record for a defined scope and actual findings. It is not government certification or accreditation.

What is included in a DPDP readiness assessment?+

We agree a scope, review relevant data handling and digital systems, document observations, identify potential gaps and recommend next steps.

Is updating my website privacy policy enough?+

Often more needs review, including actual collection, notices, applicable consent, request handling, safeguards and retention. A website review alone cannot establish company-wide compliance.

How long does a DPDP assessment take?+

Timing depends on the number of systems, processes and stakeholders. We agree the scope and schedule before starting.

Can Kaivan Tech implement the recommended technical changes?+

Yes. We can implement agreed changes in websites, applications and business systems after reviewing your technology stack.

What is the difference between a website assessment and a company-wide assessment?+

A website assessment is limited to selected web experiences and connected data flows. A broader assessment also considers selected internal processes and systems.

Can the assessment be tailored to my organisation?+

Yes. We agree the systems, processes and deliverables to review before work begins.

Does a private assessment certificate guarantee compliance?+

No. It records the review within its stated scope and limitations. It is neither a legal opinion nor proof of complete compliance.

What happens after the assessment is completed?+

You receive documented findings and a remediation plan. We can then scope implementation, verification and ongoing technical support.
